By accessing or using the services provided by SetSmart, Inc. (referred to as "SetSmart.io"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

SetSmart.io provides an AI-powered lead qualification and appointment setting service across WhatsApp, Instagram, and Facebook Messenger. Our platform is designed for coaches, infopreneurs, and agencies looking to grow their business effortlessly. SetSmart.io helps you get more appointments through automated AI setting, qualifying your leads and scheduling meetings on autopilot.

3. User Accounts

To access certain features of SetSmart.io, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. User is responsible for maintaining the confidentiality of his account. Customer using the website who are Minor /under the age of 18 shall not register as a User of the website and shall not transact on or use the website.

5. Intellectual Property

All content and materials available on SetSmart.io are the property of SetSmart, Inc. and are protected by applicable intellectual property laws.

6. Limitation of Liability

SetSmart, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use SetSmart.io.

7. Governing Law and Jurisdiction

The State of Delaware, United States, is our country of domicile. These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any purchase, dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of the State of Delaware.

8. Payment

Payments are securely processed by our payment processor, Stripe (a PCI-DSS Level 1 certified provider). Visa, Mastercard, and American Express debit and credit cards in EUR or USD are accepted. Your card details are collected and stored by Stripe and are never stored on SetSmart's own servers. The price and currency displayed at the checkout page are the price and currency charged to your card, and will match your receipt. We will not trade with or provide any services to OFAC and sanctioned countries. Cardholders should retain a copy of their transaction records and of SetSmart.io's policies and rules.

9. Payment Confirmation

Once the payment is made, the confirmation notice will be sent to the client via email within 24 hours of receipt.

10. Subscription Terms, Pricing & Auto-Renewal

SetSmart.io is sold as a recurring subscription, billed through Stripe. New subscriptions start with a free trial (7 days by default, or longer if a promotional code is applied). At the end of the free trial, your payment method is automatically charged and your subscription automatically renews — monthly or annually, depending on the plan and billing period you selected at checkout — until you cancel. Annual plans are billed once per year (annual billing includes two months free versus monthly).

Plans and pricing. SetSmart is offered in several plans (such as Starter, Pro, and Scale), each with a fixed monthly or annual price and a set allowance of AI messages included per billing cycle. The current prices and message allowances are shown on our pricing page and directly inside the checkout.

Automatic message top-ups. If you use up the AI messages included in your plan before the end of a billing cycle, additional message packs ("top-ups") are purchased automatically and charged to your payment method on file so your AI keeps running. You can set a monthly top-up spending cap from your dashboard; these automatic charges stop once the cap is reached. Unused messages do not roll over between billing cycles.

Prices are displayed and charged in EUR or USD depending on the currency shown at checkout. All prices are exclusive of any applicable taxes, which may be added at checkout depending on your location. Customers on previous or custom plans keep the pricing of the plan they originally subscribed to.

11. Refund Policy

We offer a 30-day money-back guarantee on your first paid charge: within 30 days after your first paid charge, you may request a full refund without explanation by emailing contact@setsmart.on.crisp.email. Refunds beyond the 30-day window are reviewed case-by-case at our discretion. Full details are available on our Refund Policy page.

12. Cancellation Policy

You can cancel your subscription at any time, in one click, from your dashboard at setsmart.io/app/subscribe. After cancellation, your account remains fully active until the end of the period you have already paid for, and no further charges will occur. Cancelling does not generate a refund of the current period unless you are within the 30-day money-back window described above.

13. Changes to Terms

SetSmart.io reserves the right to modify these Terms of Service at any time. We will notify users of any significant changes.
